The firm\u2019s contact details are as follows: Andrew Dunn,<br \/>\nandy@valleyaccountancy.com<\/p>\n<p>We may amend this<br \/>\nprivacy notice from time to time. If we do so, we will supply you with and\/or<br \/>\notherwise make available to you a copy of the amended privacy notice.<\/p>\n<p>Where we act as a<br \/>\ndata processor on behalf of a data controller (for example, when processing<br \/>\npayroll), we provide an additional schedule setting out required information as<br \/>\npart of that agreement. That additional schedule should be read in conjunction<br \/>\nwith this privacy notice.<\/p>\n<p><strong>The purposes<br \/>\nfor which we intend to process personal data<\/strong><\/p>\n<p>We intend to process personal data<br \/>\nfor the following purposes<\/p>\n<ul>\n<li>To enable us to supply<br \/>\nprofessional services to you as our client.<\/li>\n<li>To fulfil our<br \/>\nobligations under relevant laws in force from time to time (e.g. the Money<br \/>\nLaundering, Terrorist Financing and Transfer of Funds (Information on the<br \/>\nPayer) Regulations 2017 as amended (\u201cMLR 2017\u201d)).<\/li>\n<li>To comply with<br \/>\nprofessional obligations to which we are subject as a member of Association of<br \/>\nAccounting Technicians<\/li>\n<li>To use in the<br \/>\ninvestigation and\/or defence of potential complaints, disciplinary proceedings<br \/>\nand legal proceedings.<\/li>\n<li>To enable us to invoice<br \/>\nyou for our services and investigate\/address any attendant fee disputes that<br \/>\nmay have arisen.<\/li>\n<li>To contact you about<br \/>\nother services we provide which may be of interest to you if you have consented<br \/>\nto us doing so.<\/li>\n<\/ul>\n<p><strong>The legal bases<br \/>\nfor our intended processing of personal data<\/strong><\/p>\n<p>Our intended processing of<br \/>\npersonal data has the following legal bases<\/p>\n<ul>\n<li>At the time you<br \/>\ninstructed us to act, you gave consent to our processing your personal data for<br \/>\nthe purposes listed above<\/li>\n<li>The processing is<br \/>\nnecessary for the performance of our contract with you.<\/li>\n<li>The processing is<br \/>\nnecessary for compliance with legal obligations to which we are subject (e.g.<br \/>\nMLR 2017).<\/li>\n<li>The processing is<br \/>\nnecessary for the purposes of the following legitimate interests which we<br \/>\npursue<\/li>\n<\/ul>\n<p>It is a requirement of our contract with you that you provide us with the<br \/>\npersonal data that we request. If you do not provide the information that we<br \/>\nrequest, we may not be able to provide<br \/>\nprofessional services <em>to you. If this is<br \/>\nthe case, we will not be able to commence acting or will need to cease to act.<\/em><\/p>\n<p><strong>Persons\/organisations<br \/>\nto whom we may give personal data<\/strong><\/p>\n<p>We may share your personal<br \/>\ndata with:<\/p>\n<ul>\n<li>HMRC<\/li>\n<li>any third<br \/>\nparties with whom you require or permit us to correspond<\/li>\n<li>subcontractors<\/li>\n<li>an alternate<br \/>\nappointed by us in the event of incapacity or death<\/li>\n<li>tax<br \/>\ninsurance providers<\/li>\n<li>professional<br \/>\nindemnity insurers<\/li>\n<li>our<br \/>\nprofessional body Association of Accounting Technicians and\/or the Office of Professional Body<br \/>\nAnti-Money Laundering Supervisors (OPBAS) in relation to practice assurance<br \/>\nand\/or the requirements of MLR 2017 (or any similar legislation)<\/li>\n<\/ul>\n<p>If the law allows or requires<br \/>\nus to do so, we may share your personal data with:<\/p>\n<ul>\n<li>the police<br \/>\nand law enforcement agencies<\/li>\n<li>courts and<br \/>\ntribunals<\/li>\n<li>the<br \/>\nInformation Commissioner\u2019s Office (ICO)<\/li>\n<\/ul>\n<p>We may need to share your<br \/>\npersonal data with the third parties identified above in order to comply with<br \/>\nour legal obligations, including our legal obligations to you.\u00a0 If you ask us not to share your personal data<br \/>\nwith such third parties we may need to cease to act.<\/p>\n<p><strong>Transfers of<br \/>\npersonal data outside the EEA<\/strong><\/p>\n<p>Your personal data<br \/>\nwill be processed in the EEA only<\/p>\n<p><strong>Retention of<br \/>\npersonal data<\/strong><\/p>\n<p>When acting as a<br \/>\ndata controller and in accordance with recognised good practice within the tax<br \/>\nand accountancy sector we will retain all of our records relating to you as<br \/>\nfollows:<\/p>\n<ul>\n<li>where<br \/>\ntax returns have been prepared it is our policy to retain information for 7 years from the end of the tax year to which the<br \/>\ninformation relates.<\/li>\n<li>where<br \/>\nad hoc advisory work has been undertaken it is our policy to retain information<br \/>\nfor 7 years from the date the business<br \/>\nrelationship ceased.<\/li>\n<li>where<br \/>\nwe have an ongoing client relationship, data which is needed for more than one<br \/>\nyear\u2019s tax compliance (e.g. capital gains base costs and claims and elections<br \/>\nsubmitted to HMRC) is retained throughout the period of the relationship, but<br \/>\nwill be deleted 7 years after the end of the business<br \/>\nrelationship unless you as our client ask us to retain it for a longer period.<\/li>\n<\/ul>\n<p>Our contractual<br \/>\nterms provide for the destruction of documents after 7 years and therefore agreement to the contractual<br \/>\nterms is taken as agreement to the retention of records for this period, and to<br \/>\ntheir destruction thereafter.<\/p>\n<p>You are responsible for retaining information that we send to<br \/>\nyou (including details of capital gains base costs and claims and elections<br \/>\nsubmitted) and this will be supplied in the form agreed between us. Documents<br \/>\nand records relevant to your tax affairs are required by law to be retained by<br \/>\nyou as follows:<\/p>\n<p><em>Individuals,<br \/>\ntrustees and partnerships<\/em><\/p>\n<ul>\n<li>with<br \/>\ntrading or rental income: five years and 10 months after the end of the tax<br \/>\nyear;<\/li>\n<li>otherwise:<br \/>\n22 months after the end of the tax year.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><em>Companies,<br \/>\nLLPs and other corporate entities<\/em><\/p>\n<ul>\n<li>six<br \/>\nyears from the end of the accounting period.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Where we act as a data processor as defined<br \/>\nin DPA 2018, we will delete or return all personal data to the data controller<br \/>\nas agreed with the controller annually\/at the termination of the contract<\/p>\n<p><strong>Requesting<br \/>\npersonal data we hold about you (subject access requests)<\/strong><\/p>\n<p>You have a right to request<br \/>\naccess to your personal data that we hold. Such requests are known as \u2018subject<br \/>\naccess requests\u2019 (\u201cSARs\u201d).<\/p>\n<p>Please provide all SARs in<br \/>\nwriting marked for the attention of Andrew Dunn<\/p>\n<p>To help us provide the<br \/>\ninformation you want and deal with your request more quickly, you should<br \/>\ninclude enough details to enable us to verify your identity and locate the<br \/>\nrelevant information. For example, you should tell us:<\/p>\n<ol>\n<li>your date of<br \/>\nbirth<\/li>\n<li>previous or<br \/>\nother name(s) you have used<\/li>\n<li>your<br \/>\nprevious addresses in the past five years<\/li>\n<li>personal<br \/>\nreference number(s) that we may have given you, for example your national<br \/>\ninsurance number, your tax reference number or your VAT registration number<\/li>\n<li>what type of<br \/>\ninformation you want to know<\/li>\n<\/ol>\n<p>If you do not have a national<br \/>\ninsurance number, you must send a copy of:<\/p>\n<ul>\n<li>the back<br \/>\npage of your passport or a copy of your driving licence; and<\/li>\n<li>a recent<br \/>\nutility bill.<\/li>\n<\/ul>\n<p>DPA 2018 requires that we<br \/>\ncomply with a SAR promptly and in any event within one month of receipt. There<br \/>\nare, however, some circumstances in which the law allows us to refuse to<br \/>\nprovide access to personal data in response to a SAR (eg if you have previously<br \/>\nmade a similar request and there has been little or no change to the data since<br \/>\nwe complied with the original request).<\/p>\n<p>We will not charge you for<br \/>\ndealing with a SAR.<\/p>\n<p>You can ask someone else to<br \/>\nrequest information on your behalf \u2013 for example, a friend, relative or<br \/>\nsolicitor. We must have your authority to respond to a SAR made on your behalf.<br \/>\nYou can provide such authority by signing a letter which states that you<br \/>\nauthorise the person concerned to write to us for information about you, and\/or<br \/>\nreceive our reply.<\/p>\n<p>Where you are a data<br \/>\ncontroller and we act for you as a data processor (eg by processing payroll),<br \/>\nwe will assist you with SARs on the same basis as is set out above.<\/p>\n<p><strong>Putting things<br \/>\nright (the right to rectification)<\/strong><\/p>\n<p>You have a right to obtain the<br \/>\nrectification of any inaccurate personal data concerning you that we hold. You<br \/>\nalso have a right to have any incomplete personal data that we hold about you<br \/>\ncompleted. Should you become aware that any personal data that we hold about<br \/>\nyou is inaccurate and\/or incomplete, please inform us immediately so we can<br \/>\ncorrect and\/or complete it.<\/p>\n<p><strong>Deleting your<br \/>\nrecords (the right to erasure)<\/strong><\/p>\n<p>In certain circumstances you<br \/>\nhave a right to have the personal data that we hold about you erased. Further<br \/>\ninformation is available on the ICO website (<a href=\"http:\/\/www.ico.org.uk\/\">www.ico.org.uk<\/a>).\u00a0 If you would like your personal data to be<br \/>\nerased, please inform us immediately and we will consider your request.\u00a0 In certain circumstances we have the right to<br \/>\nrefuse to comply with a request for erasure. If applicable, we will supply you<br \/>\nwith the reasons for refusing your request.<\/p>\n<p><strong>The right to<br \/>\nrestrict processing and the right to object<\/strong><\/p>\n<p>In certain circumstances you<br \/>\nhave the right to \u2018block\u2019 or suppress the processing of personal data or to<br \/>\nobject to the processing of that information.<br \/>\nFurther information is available on the ICO website (<a href=\"http:\/\/www.ico.org.uk\/\">www.ico.org.uk<\/a>).\u00a0 Please inform us immediately if you want us<br \/>\nto cease to process your information or you object to processing so that we can<br \/>\nconsider what action, if any, is appropriate.<\/p>\n<p><strong>Obtaining and<br \/>\nreusing personal data (the right to data portability)<\/strong><\/p>\n<p>In<br \/>\ncertain circumstances you have the right to be provided with the personal data<br \/>\nthat we hold about you in a machine-readable format, e.g. so that the data can<br \/>\neasily be provided to a new professional adviser. Further information is available on the ICO website (<a href=\"http:\/\/www.ico.org.uk\/\">www.ico.org.uk<\/a>).<\/p>\n<p>The right<br \/>\nto data portability only applies:<\/p>\n<ul>\n<li>to personal data an<br \/>\nindividual has provided to a controller;<\/li>\n<li>where the processing is<br \/>\nbased on the individual\u2019s consent or for the performance of a contract; and<\/li>\n<li>when processing is<br \/>\ncarried out by automated means<\/li>\n<\/ul>\n<p>We will respond to any data<br \/>\nportability requests made to us without undue delay and within one month.\u00a0 We may extend the period by a further two<br \/>\nmonths where the request is complex or a number of requests are received but we<br \/>\nwill inform you within one month of the receipt of the request and explain why<br \/>\nthe extension is necessary.<\/p>\n<p><strong>Withdrawal of<br \/>\nconsent<\/strong><\/p>\n<p>Where you have<br \/>\nconsented to our processing of your personal data, you have the right to<br \/>\nwithdraw that consent at any time. Please inform us immediately if you wish to<br \/>\nwithdraw your consent.<\/p>\n<p>Please note:<\/p>\n<ul>\n<li>the withdrawal of<br \/>\nconsent does not affect the lawfulness of earlier processing<\/li>\n<li>if you withdraw your<br \/>\nconsent, we may not be able to continue to provide services to you<\/li>\n<li>even if you withdraw<br \/>\nyour consent, it may remain lawful for us to process your data on another legal<br \/>\nbasis (e.g. because we have a legal obligation to continue to process your<br \/>\ndata)<\/li>\n<\/ul>\n<p><strong>Automated<br \/>\ndecision-making<\/strong><\/p>\n<p>We do not intend to use automated decision-making in relation to your<br \/>\npersonal data.<\/p>\n<p><strong>Complaints<\/strong><\/p>\n<p>If you have requested details<br \/>\nof the information we hold about you and you are not happy with our response,<br \/>\nor you think we have not complied with the GDPR or DPA 2018 in some other way,<br \/>\nyou can complain to us.
